Gutta på Haugen AS, company no. 995 232 227 (“Gutta”) operates the website Gutta.no (“Website”). Via the Website you can purchase goods from Gutta.no.
These general terms and conditions (“Terms”) apply when you as a consumer (“Customer”) place an order via the Website. In connection with the Customer making a purchase via the Website, the Customer must accept the Terms and Conditions.
By accepting Guttas Terms and Conditions, the Customer confirms that he/she has reached the age of 18 and that he/she can enter into legally binding agreements. Persons under the age of 18 may not shop on the Website. Orders placed in another person’s name (forgery), or orders that otherwise expose Gutta to the risk of financial damage, will be reported to the police. In the event of suspicion of irregularities or misuse of our service, Gutta reserves the right to cancel the Customer’s order. Gutta also does not allow orders or purchases on the Website from persons outside the borders of Norway. Guttas’s ordering system is adapted to Norwegian legal conditions, and we will not process orders that Gutta discovers come from countries other than Norway.
Guta strives to ensure that the information on the Website is always as accurate as possible, but reserves the right to make corrections at any time, including images, on Guta that come from third parties.
The Website is owned by Gutta Drift AS. The content on the Website is owned by Gutta or its licensor. The content is protected by, among other things, intellectual property and market law rules. This means that trademarks, company names, product names, images and graphics, design, layout and information about goods, services and other content cannot be copied or used without Gutta’s written consent.
In order to make a purchase via the Website, the Customer must accept the Terms. By accepting the Terms, the Customer undertakes to comply with the Terms in their entirety and at the same time confirms having received information about Gutta’s processing of personal data and cookies in accordance with Gutta’s Privacy Policy. When the Customer completes an order from Gutta, Gutta will send a preliminary order confirmation via email to the Customer. This preliminary order confirmation is automatically generated by Gutta without manual review. A binding purchase agreement is only concluded when Gutta has provided a final confirmation of the Customer’s order.
The Customer must create a user account in order to shop on Guttas Website. When the Customer registers their user account, the Customer is asked to provide certain personal information. The Customer confirms that the information provided by the Customer is accurate and complete and is responsible for any incorrect information. Information about Guttas’ processing of personal information can be found in Guttas’ Privacy Policy.
The Customer undertakes to ensure that no one other than the Customer can use the Customer’s login information. The Customer shall not provide the username and password to third parties, and shall ensure that the username and password are stored and handled in such a way that unauthorized persons cannot access the information. The Customer shall immediately notify Gutta of any suspicion of unauthorized access to the Customer’s password. Before the Customer provides Gutta with such notification, the Customer is responsible for all purchases made with the Customer’s login information.
If Gutta suspects that the Customer is misusing their user account or login information or otherwise violating the Terms, Gutta has the right to ban the Customer. Gutta also has the right to assign the Customer new login details.
All purchases on the Website are made in Norwegian kroner (NOK). Prices include VAT, unless otherwise stated. Prices do not include shipping costs, invoice surcharges, etc. Such additional costs will be presented as separate items in the checkout. The final amount is confirmed by Gutta in connection with the final confirmation sent to the Customer, cf. point 2 of the Terms. In the event of changes in tax or VAT conditions or other conditions beyond Gutta’s control, Gutta has the right to adjust the price up to the day before the goods are sent to the Customer.
The Customer can choose one of the payment methods listed on the Website, including invoice payment, Klarna account, mobile payment and card payment. All payment methods are made through Guttas partner Klarna ( www.klarna.com/no/ ) and their payment solution Klarna Checkout. By providing information at checkout, the Customer also accepts Klarna’s terms and conditions (a link to Klarna’s terms and conditions can be found further down in this section). Klarna Checkout presents information to the Customer as soon as the Customer is identified. The information that must be provided in order to identify the Customer may vary depending on the purchase case and customer. The payment option selected by the Customer may also have an impact on the information required in Klarna Checkout. Credit information that Klarna obtains does not affect the Customer’s creditworthiness and cannot be seen by others who request credit information, such as banks. After the Customer has been identified, Klarna Checkout shows which payment options are available. Invoice is the payment option that is selected as a starting point, but the Customer can choose one of the other options if the Customer so wishes. The payment options offered to the Customer may change from time to time. The Customer may choose whether to protect the use of Klarna Checkout with a PIN code.
When paying by invoice, there will be a minimum payment period of 14 days (see complete Terms and Conditions from Klarna here ).
Gutta reserves the right not to always offer all forms of payment, as well as to change the payment method if the payment method the Customer has chosen for some reason does not work at the time of purchase or the Customer is not approved for the chosen payment method.
If the customer wishes to use Vipps as a payment method, we also offer this.
Delivery of the Customer’s goods takes place, unless otherwise stated, to the address the Customer has provided. Normal delivery time is 1-4 business days from confirmed order. In some cases, goods will be made to order and the delivery time can be up to 10 days. Orders placed before midnight Sunday are usually shipped on Monday. Orders placed before midnight Monday are usually shipped on Tuesday. Orders from customers from Oslo and Akershus will also be shipped on Wednesday. At checkout, various delivery options will be presented, and the Customer chooses which option Gutta should use for the order in question.
Should any of the ordered items have a significantly longer delivery time than other items, Gutta reserves the right to split the order. In such a case, the customer will not be charged any additional costs for subsequent deliveries.
Should Gutta for any reason not be able to deliver the Customer’s order within the stated delivery time, the Customer will be informed via email or telephone. The Customer may then cancel the purchase by contacting customer service at: nettbutikk@gutta.no. If the Customer has already paid for the item, the amount will be returned to the account that was debited at the time of purchase. In the event of a delivery delay, the Customer will not be entitled to any compensation other than a refund of the amount already paid.
Delivery costs depend on the shipping option selected and will be presented to the Customer at checkout. Gutta offers free shipping on purchases over 1500kr when delivered to a single address.
The risk in the goods is transferred to the Customer when the Customer receives the goods. The Customer undertakes to examine the goods immediately upon receipt to verify that they are the correct goods and that they are free from defects.
The Customer has the right to withdraw from the agreement without giving any reason for this in accordance with the Right of Withdrawal Act. The withdrawal period is 14 days from the date the Customer received the goods. If the Customer has ordered several goods in one and the same order, the withdrawal period expires 14 days after the day the Customer receives the last item. The right to exercise the right of withdrawal assumes that the seal or packaging has not been broken after delivery. The right of withdrawal is exempt from food products and other goods with a short shelf life or are of a nature that is not suitable for return.
If the Customer wishes to exercise the right of withdrawal, the Customer must notify Gutta in an unequivocal manner of his decision to cancel the purchase. This can be done by notifying Gutta via email to nettbutikk@gutta.no. In order to comply with the withdrawal period, it is sufficient for the Customer to send notification that the Customer wishes to exercise the right of withdrawal before the withdrawal period expires.
The Customer must bear the costs of returning the goods if the right of withdrawal is exercised. The Customer is responsible for the condition of the goods from the time the Customer received the goods and up to the return shipment. The goods must be returned within 14 days from the day the Customer notified Gutta that the Customer wished to exercise the right of withdrawal.
If the Customer wishes to exercise the right of withdrawal, Gutta will refund all payments received from the Customer, including delivery costs (with the exception of additional costs resulting from the Customer having chosen a type of delivery other than the cheapest type of standard delivery offered by Gutta), without undue delay and in any event no later than 14 days after the day on which Gutta received notification of the Customer’s decision to withdraw from the agreement. Gutta will make the refund to the account that was debited at the time of purchase, unless otherwise expressly agreed between the parties. Gutta may withhold the refund until Gutta has received the goods back or until the Customer has provided documentation that the goods have been returned, or until whichever of these times occurs first. Gutta is entitled to deduct an amount corresponding to the reduction in value of the goods if and to the extent that such reduction in value is due to the Customer’s handling of the goods that has not been necessary to determine the nature, characteristics and function of the goods.
/The right of complaint covers goods that are defective according to applicable consumer legislation. If there are any errors in the goods you have received or if something is missing, you must contact Gutta at nettbutikk@gutta.no as soon as possible after the error is discovered. In connection with the complaint, the order number and the reason for the complaint must be stated. The Customer must request a return number (RN) and a shipping label. Shipments that lack a return number (RN) will be returned to the sender and shipping costs will be charged to the Customer. The shipping label will be valid for 14 days. Complaints made within two months after the Customer has discovered the error are always considered timely. The Customer has a 2-year right of complaint for goods purchased on the Website.
Defective goods retured to Gutta should be treated as if they were flawless. For all types of returns, it is very important that the goods are packaged in such a way that they do not risk being damaged.
Gutta is always responsible for the return costs of damaged or faulty goods, i.e. for approved complaints. When the goods complained about have been returned and Gutta has approved the complaint, the Customer will be compensated. Gutta’s liability is limited to what the Customer has paid for the goods and any return costs. If the Customer has already paid for the goods, and unless the parties agree otherwise, the refund will be made to the account that was debited at the time of purchase. Such refunds are usually made within 14 days.
Gutta reserves the right to reject a complaint if Gutta finds that the goods are not defective according to applicable consumer legislation. In cases where the goods are returned due to a complaint and a defect cannot be detected, the Customer will have to pay a fee corresponding to the costs Gutta has incurred in connection with administration, shipping and handling of the case, up to a maximum of NOK 299. The fee is invoiced with a 14-day payment deadline. In the event of late payment, late payment interest will be charged according to the Late Payment Interest Act. A reminder fee of NOK 70 will also be charged if the payment deadline is exceeded by 14 days.
Gutta would like to inform the customer that there will be exceptions for certain food items, and transport damage must be taken up with Gutta’s shipping supplier. Many items on Gutta’s website are items that require cold storage, and in cases where the item has gone bad because the customer has not collected the item at the pick-up location or been home for delivery on time, the customer will not be entitled to a refund.
On the Website, Gutta may link to other websites outside of Gutta’s control. Gutta seeks to ensure that Gutta only links to websites that have similar privacy policies to those set out in Gutta’s Privacy Policy. However, Gutta is not responsible for the protection or confidentiality of information or personal data that the Customer has provided on other websites.
Gutta is not responsible for delays caused by circumstances beyond Gutta’s control, such as general labor disputes, war, fire, lightning strikes, terrorist attacks, changes in legislation or regulations, technical problems, failures of electricity/telephone/data connections or other communication failures or failures or delays in subcontractor services due to circumstances as mentioned. Such circumstances will entail exemption from compensation and other sanctions. If such a situation arises, Gutta shall inform the Customer. If the relationship has lasted longer than 2 months, both the Customer and Gutta have the right to cancel the purchase with immediate effect.
Gutta reserves the right to change the Terms at any time and without the Customer’s prior consent. Any such change will be published on the Website. Changes to the Terms are effective from the Customer’s acceptance of the Terms in connection with new purchases (if the change relates to purchases on the Website), or from the Customer’s visit to the Website (if the change relates to the use of the Website), or 10 days from Gutta informing the Customer of the changes.
If one or more provisions of these Terms are contrary to applicable law or are declared invalid by a court or relevant supervisory authority, this shall not affect the validity of the remaining provisions of the Terms.
The Guys have the right, without the Customer’s consent, to transfer their rights and obligations under the Terms in whole or in part to a third party.
Gutta’s goal is always that the Customer should be as satisfied as possible. If a dispute should arise between the parties, the parties shall attempt to resolve any disputes amicably. All disputes shall be resolved in accordance with Norwegian law. If the matter is brought before the courts, it shall be decided in the Customer’s jurisdiction, which is normally near where you live.
